PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING ANY nursebite COURSE, PROGRAM, OR CONTENT.

By enrolling in, accessing, or using any nursebite course, product, or service, you ("Student" or "User") agree to be legally bound by these Terms and Conditions ("Terms") in their entirety. If you do not agree, please do not access or use the Content. These Terms apply to all students, visitors, and users of nursebite's courses, programs, and digital products, which are owned and operated by TWC Pinnacle, LLC, dba nursebite.

1. Acceptance of Terms

By accessing any nursebite course, product, or platform, you represent that you are at least 18 years of age (or have parental/guardian consent), that you have read and agree to these Terms, and that you have the legal authority to enter into a binding agreement. These Terms constitute a legally binding contract between you and TWC Pinnacle, LLC.

2. Accounts and Access

To access nursebite courses, you must create an account through the nursebite platform (currently hosted on Kajabi). You are responsible for maintaining the confidentiality of your login credentials. You may not share your account, credentials, or course access with any third party. nursebite reserves the right to terminate access for any account found to be shared or misused, without refund.

3. Intellectual Property

All Content provided through nursebite, including but not limited to video lessons, workbooks, scripts, knowledge checks, AI prompts, graphics, and brand assets, is the exclusive intellectual property of TWC Pinnacle, LLC, dba nursebite, and is protected under applicable copyright, trademark, and intellectual property laws. Your enrollment grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your own personal, non-commercial educational purposes. No ownership rights are transferred to you.

4. Payment, Pricing, and Enrollment

All prices for nursebite courses and programs are stated in U.S. dollars and are subject to change without notice. Payment is due at the time of enrollment. nursebite may offer payment plans at its sole discretion. You are responsible for any applicable taxes. Enrollment is complete upon receipt of full payment and creation of your course account.

5. Refund Policy

All sales are final unless otherwise stated at the time of purchase. nursebite may, in its sole discretion, offer a satisfaction guarantee or refund window on specific products, which will be clearly communicated at the point of purchase. Refund requests must be submitted in writing to [email protected] within the stated refund window, if applicable. Chargebacks initiated without first contacting nursebite will result in immediate account termination and forfeiture of access.

6. Prohibited Conduct

As a student or user of nursebite, you agree that you will NOT:

• Reproduce, distribute, resell, sublicense, or exploit any nursebite Content for commercial purposes.
• Screen-record, screenshot, or re-upload any course video or material to any third-party platform.
• Share your account credentials or course access links with any person who has not paid for enrollment.
• Use nursebite Content to create competing courses, programs, or educational products.
• Engage in harassment, abusive behavior, or disruptive conduct toward nursebite staff, community members, or other students.
• Misrepresent your identity or impersonate any person in connection with nursebite.
• Engage in any use of nursebite Content that violates applicable laws or regulations.

7. Educational Disclaimer

All nursebite Content is provided for general educational and informational purposes only. Nothing in any nursebite course or program constitutes professional nursing advice, medical or clinical advice, legal advice, financial advice, or any other form of professional advisory service. Completion of any nursebite course does not confer a license, credential, certification, or any academic credit. Students are responsible for verifying all information with appropriate professional and regulatory authorities. See the separate Disclaimer and Disclosure document for full details.

8. No Guarantee of Outcomes

nursebite makes no representations, warranties, or guarantees, express or implied, that completion of any course will result in specific academic, clinical, employment, licensure, or financial outcomes. 9. Limitation of Liability

To the fullest extent permitted by applicable law, TWC Pinnacle, LLC, nursebite, its founder, affiliates, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of, or inability to use, any nursebite course, program, or Content. This includes but is not limited to damages for lost income, lost opportunity, academic setback, or emotional distress, regardless of whether nursebite has been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless TWC Pinnacle, LLC, nursebite, its founder, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of nursebite Content, your violation of these Terms, or your infringement of any third-party rights.

11. Third-Party Platforms and Tools

nursebite courses may reference, recommend, or provide links to third-party platforms, tools, or resources, including artificial intelligence tools such as Claude and ChatGPT. These references are for educational convenience only. nursebite does not endorse, control, or assume responsibility for the accuracy, availability, privacy practices, or content of any third-party resource. Your use of any third-party tool or platform is governed solely by that party's own terms of service and policies. References to AI tools are intended to demonstrate educational and research applications only; students are solely responsible for ensuring their use of AI tools complies with their institution's academic integrity policies.

12. Modifications to Terms

nursebite reserves the right to update, modify, or revise these Terms at any time. Changes will be effective upon posting to the nursebite platform. Your continued use of nursebite Content following any update constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of nursebite Content shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Dallas County, Texas. You waive any right to a jury trial or to participate in a class action lawsuit.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions of these Terms will continue in full force and effect.

15. Entire Agreement

These Terms, together with the nursebite Copyright Notice and Disclaimer and Disclosure, constitute the entire agreement between you and TWC Pinnacle, LLC with respect to your use of nursebite Content and supersede all prior and contemporaneous agreements, representations, and understandings.
